Is medical cannabis legal in the UK?

Medical cannabis has been legal in the UK since 2018 when prescribed by a specialist doctor. However, access remains limited and many patients are unsure how the process works.

Overview

In November 2018, the UK took a significant step forward in recognising cannabis-based treatments as a legitimate medical option. For the first time, specialist doctors were legally permitted to prescribe cannabis-based medicinal products — known as CBPMs — to patients who met specific clinical criteria.

However, legal does not mean straightforward. Despite being available for over five years, access remains tightly controlled, often misunderstood, and for many patients, difficult to navigate without proper guidance. This article explains exactly how the law works, who can prescribe, and what the process actually looks like in practice.

What changed in 2018 — and who can prescribe?

Prior to November 2018, cannabis was classified as a Schedule 1 controlled substance in the UK — meaning it was considered to have no recognised medical value and could not be prescribed under any circumstances. The 2018 rescheduling changed that, moving cannabis-based medicinal products to Schedule 2 and allowing them to be prescribed under strict conditions.

Crucially, this change did not open prescribing to GPs. Medical cannabis can only be prescribed by a specialist doctor listed on the General Medical Council (GMC) register, who has relevant experience treating your specific condition. In the vast majority of cases, prescriptions are issued through private clinics rather than the NHS — because NHS prescribing remains extremely limited and is largely unavailable for most qualifying conditions.

NHS access and what "legal" actually means for patients

NHS prescriptions for medical cannabis exist, but in practice they are reserved for a very narrow set of conditions:

  • Severe epilepsy (such as Dravet syndrome or Lennox-Gastaut syndrome)
  • Chemotherapy-induced nausea and vomiting
  • Multiple sclerosis-related muscle spasticity

For the overwhelming majority of patients — those managing chronic pain, anxiety, PTSD, insomnia, or other conditions — access is through private healthcare. This is where clinics like Kushems operate: providing fully regulated, legally compliant prescriptions through licensed specialist doctors.

When we say medical cannabis is legal in the UK, it means the following for patients: you can be formally prescribed cannabis-based medication by a licensed specialist; your prescription is fulfilled by a regulated pharmacy; and your treatment is monitored and professionally adjusted over time. It does not mean over-the-counter access or self-administration without medical oversight — everything remains within a structured medical framework.

Key takeaway

Medical cannabis is legal, regulated, and accessible in the UK — but the route to a prescription is more structured than many patients expect. Understanding the framework is the first step. If you believe you may qualify, the most effective next step is speaking with a specialist who can assess your history and guide you through the process properly.
